MLC Full Form – What is MLC?

The Legislative Council (MLC) is elected in six states of India and is constituted under Articles 169,171 (1) and 171 (2) of the Indian Constitution.

The number of MLC members is one third of the number of members of the Legislative Assembly (MLA) but some rules were made separately for Jammu and Kashmir, however after the abolition of section 370, the Legislative Council in this state should be abolished.

The powers of the members of the Legislative Council are equal to those of the members of the Legislative Assembly, such as – carts, security squads and constituency funds equal to the legislators.

MLC Full Form

The MLC form is Member of Legislative Council. A member of the Legislative Council (MLC) is elected by the local bodies, state legislative assembly, governors, graduates and teachers for a term of 6 years. In this process one third of the members retire every two years, and new members are elected.

MLC Qualification Required

  • First of all it is mandatory to be a citizen of India.
  • He must have completed at least 30 years of age.
  • Not to be declared mentally insane and bankrupt.
  • Apart from being a resident of that area, it is also necessary to have his name in the voter list.
  • At the same time, he should not be a Member of Parliament and appointed to any official position.

How is an MLC Elected?

The Legislative Assembly and the Legislative Council are the major organs of the state government. For the election of MLC, one-third of the members of the Legislative Council are elected by the members of the State Legislative Assembly. And the other one-third are elected by the members of the local bodies ie the members of the municipality and the district board. 1/12 of the members are done by state teachers and the remaining 1/12 of the members are graduated by registered voters. Only after which an MLC is selected.

States Having Legislative Council

In some Indian states, the Upper House of Representatives of Democracy is called the Legislative Council. This arrangement has been done in the states of Andhra Pradesh, Bihar, Karnataka, Maharashtra, Telangana and Uttar Pradesh.

At present, there are six governments in India formed by the Legislative Council. Apart from this, according to information given in Wikipedia, Rajasthan, Assam, Odisha have been approved by the Parliament of India to form their own Legislative Council.

Also, Legislative Council has been formed in these Union Territories –

  • Jammu Kashmir
  • Delhi, and
  • Pondicherry

Constitution of Legislative Council

The constitution of the Legislative Council has been mentioned in Articles 169, 171 (1) and 171 (2) of the Constitution. The process of formation is as follows –

  • In order to constitute it in a state, it is necessary to get the resolution passed by a two-thirds majority of the members present in the assembly and then to be sent to the federal parliament.
  • After this, according to Article 171 (2), the Lok Sabha and the Rajya Sabha act to pass the resolution with a simple majority.
  • After this the proposal has to be sent for the President’s signature.
  • If the President is signed, then the approval of the formation of the Legislative Council is obtained.
